   By commissioning Net Builders, accessing, browsing or using this web site, you are agreeing to comply and be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any of these terms, you should not engage Net Builders and are prohibited from using or accessing this web site. The materials contained in this web site are protected by applicable copyright and trade mark law.

9. Governing Law

Any claim relating to Net Builders performance or this web site shall be governed by the laws of New Zealand without regard to its conflict of law provisions.

10. Invoicing

Any amount invoiced by Net Builders is payable within 10 working days from the date of invoice. Terms variation may be requested in writing to  This e-mail address is being protected from spambots. Where variance is not provided and payment not received within 10 working days, a penalty is 20% per annum calculated monthly from the date of invoice will apply. Where accounts are not settled within 2 months of the date of initial invoice, debt collection action will begin and all costs relating to debt collecting will be payable by the debtor.

11. Disputes

Disputed invoices are to be ultimately addressed through the Disputes Tribunal. Where a client wishes to dispute an invoice they must post a registered explanation outlining their dispute to Net Builders, PO Box 5455, Papanui, Christchurch. The client agrees to loss of right to confidentiality and agrees to publication of their details where debt is outstanding by more than 2 months.

12. Deposits and commissioning work

Engaging or commissioning Net Builders to perform work is deemed to have initiated from either the payment of a deposit or the issue of invoice. All deposits are non-refundable unless required by applicable law. Net Builders provide two types of work, commissioned or packaged. Where work is commissioned at hourly rates, the ownership of the source code and configured system resides with the commissioner upon full account settlement. Where work is performed as part of a package, the ownership of the source code and configured system resides with Net Builders. Systems and source code ownership can be transferred with written request and only after payment for transfer time and the difference between package prices and the hourly charge the system would have cost if it were commissioned.

13. Refund / Disputes and Payment Policy

Net Builders will meet our obligations as per the consumer guarantees act with regards to refunds. Please include the circumstances and reasoning behind why a refund is required. We will endeavour to reply within 10 working days to your request. All payments made are in New Zealand dollars.



14. Privacy Policy

Your privacy is very important to us. Accordingly, we have developed this policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information. The following outlines our privacy policy.

Net Builders may collect the following personal information about you when you become a Net Builders member: e.g. Business name, contact name and details, year of birth, business products / services and other business and personal interests etc.

Net Builders requires this information to understand your needs and provide you with a better service, and in particular to: offer other products and services that may be of interest.

We will only retain personal information as long as necessary for the fulfilment of those purposes.

We will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorised access, disclosure, copying, use or modification.

We will not sell or lease your personal information to third parties unless we have your permission or are required by law to do so.

You specifically permit Net Builders to use your name, photo or avatar and city in promotional materials.
